A. Termination

These Terms & Conditions of Use (the "Terms") apply to the website of Novel Homes Collective located at NovelHomesCollective.co and all associated sites linked to it (collectively, the "Site"). The Site is the property of Novel Homes Collective and its affiliates. By using the Site, you agree to these Terms; if you do not agree, please do not use the site.

Novel Homes Collective reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms at any time. It is your responsibility to review these Terms periodically for changes. Your continued use of the Site following the posting of any changes will signify your acceptance of and agreement to the revised Terms. As long as you comply with these Terms, Novel Homes Collective grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

B. Content Ownership & Usage

All text, graphics, photographs, videos, designs, logos, trademarks, music, artwork, and any other media (collectively, "Content") provided by Novel Homes Collective are owned or licensed by Novel Homes Collective and are protected under copyright, trademark, and other intellectual property laws.

As a realtor, you are granted a limited, non-transferable license to use the Content solely for the purpose of marketing and promoting the property listed in your real estate portfolio. This license is strictly for your personal use and does not extend to resale, redistribution, or sharing of Content with third parties, including but not limited to contractors, interior designers, trades, or other external parties. You may not use the Content for any other commercial purpose without explicit written permission from Novel Homes Collective.

By accessing or using our services, you agree to abide by these terms. Any unauthorized use of the Content or violation of these terms may result in the termination of your license to use the materials and could lead to legal action.

C. Payment and Billing

Payment for all media services is due at the time of delivery. If a deposit is required, Novel Homes Collective will coordinate the details and timing of the payment. Failure to remit payment for any media provided within the specified terms will result in additional fees, including late charges, and may lead to legal action to recover the outstanding amount. Failure to pay for listing photos at the time of delivery will result in media being pulled from the MLS.

D. Data Privacy & Security

Novel Homes Collective is committed to protecting your privacy and the security of your personal information. We implement reasonable security measures to safeguard your data from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. By using our Site, you acknowledge that you understand the risks associated with data transmission and storage online.

E. Intellectual Property

Except as expressly stated in these Terms, no part of the Site or any Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any form (including "mirroring") to any computer, server, website, or other medium for publication, distribution, or any commercial purpose without the prior written consent of Novel Homes Collective.

All ownership rights to the Content remain with Novel Homes Collective, unless ownership is explicitly transferred in writing and purchased.

F. Cancellation Policy

Clients must provide written notice of cancellation for a project or event as soon as possible. Any initial non-refundable deposit will be forfeited upon cancellation.

If work has already begun but the full amount has not been paid, Novel Homes Collective reserves the right to invoice for the time invested, work completed, and expenses incurred up to the cancellation date. If the client has paid in full prior to completion and then cancels, Novel Homes Collective will determine if a partial refund will be issued based on the same factors.
